To users of “QuiX Club” (the “Website”) - Terms of Conditions of Membership

The service provided on the Website shall be the service which is available to the Service Users or Temporary Service Users (as defined below), called “Creation of Unique Stamp Using OSMO System” (the “Service”). Functions which are available on the Website shall be limited for the Temporary Service Users, for example, they cannot download the program and data.

The Service provided on the Website may be used in accordance with the terms and conditions of membership (these “Terms and Conditions”). Matters not provided for in these Terms and Conditions shall be handled in accordance with the “Terms of Use” of the Shachihata Xstamper QuiX official website (the “Terms of Use”).

To use the Service provided on the Website, it is necessary to carefully read the provisions of the Terms of Use and these Terms and Conditions below and agree with all of the provisions. Any person who has used the Service provided on the Website shall be deemed to have agreed with all of the provisions of the Terms of Use and these Terms and Conditions. Accordingly, those who cannot agree with all of the provisions of the Terms of Use and these Terms and Conditions may use the Service as Website Visitor as defined in the “Classification and Rights of Users” in these Terms and Conditions.

The privacy policy shall apply when the user of the Website uses the Service provided on the Website. Further, the personal information of the Service Users shall be handled in accordance with the privacy policy established by the Website.

1. Classification and Rights of Users

People who use the Website (the “Website Users”) shall be classified as follows.

2. Service provided on the Website

There is no assurance that the Service provided on the Website will be continued to be provided in the future. Further, various types of Service may be added, changed, suspended or deleted without prior notice to the Website User. The Website has granted a license to the Service Users to use the Service provided on the Website, but there is no assurance that the information posted for the Service is provided for sure, or about access or output.
If a Website User performs a harassing behavior or defamation using the Service on the Website or the use of such Service is deemed inappropriate by the Website, the Website may at its discretion restrict the use of all or part of the Service without prior notice.

3. Restrictions on Use

The Website User shall comply with the privacy policy, the Terms of Use and these Terms and Conditions (collectively, the “Terms”). Further, if deemed necessary by the Website, the Terms concerning the use of the Service may be revised at any time without prior notice to the Website User. Moreover, the Website has the right to restrict the use by the Website User at its discretion. If the Website suffers damage due to an act of the Website User, the Website may claim the relevant Website User for compensation of damages.

4. Management of e-mail address and password

The Website User shall be responsible for managing his/her e-mail address and password used for the Service.
The Website User may not in any event assign or lend his/her e-mail address or password to a third party. If someone has logged in to the Website when a combination of e-mail address and password conforms to the registered information, the Website considers that the Website User who has registered such e-mail address is using the Website.

5. Notices and communications

In principle, the Website shall notify or contact the Website User or respond to an inquiry from the Website User by e-mail. If it is difficult to contact the Website User by email, the Website shall call the Website User. Any opinion, request and question from the Website User to the Website shall be given to a point of contact designated by the Website using a dedicated form. There is no assurance that a response will be made for sure to an opinion, request or question given by any other means. Further, please be noted that the Website does not handle an opinion, request or question which is deemed by the Website to be contrary to the purport of the Website.

6. Posting of advertisement

The Website may post an advertisement of the Website or a third party who requested the Website post his/her advertisement on the Service or software to be provided.

7. Deletion of member information (withdrawal)

The Service User may at his/her option “delete the member information” (“Withdraw”) from the Website. The Service User shall be deemed to have Withdrawn from the Website after the completion of the Withdrawal procedures. Once the Service User has Withdrawn, his/her e-mail address and password which have been used until then shall also be deleted and cannot be restored.

8. Exemption from liability

The Website shall not be liable for direct, incidental, consequential, indirect or punitive damage, expense, loss or obligation arising because the Website User gained access to and used the Website. The Website shall not be liable for damage or virus infection to computers or other equipment arising due to the Website User’s access to or download from the Website or printing of all or part of the pages of the Website.

If the Website deems it inappropriate, the Website may at its discretion restrict the use of all or part of the Service or rescind a membership registration and refuse to provide the Service thereafter.
Further, the Website shall not be liable for any damage incurred by the Website User or a third party as a result thereof.

The Website shall not give support with respect to the use of the Service provided by the Website by telephone or facsimile without compensation. Further, the Website shall not give any support for computers, communications equipment or communications software used by the Website User. The Website shall not receive any complaints about connection between the Website User and various providers.

If a complaint is made or claim for compensation for damages is filed by a third party against the Website User due to or in connection with the use of the Service provided on the Website, communication, statement or content transmitted using the Website, connection with the Website, breach of the Terms of the Website, infringement of someone’s rights or other reason, the Website User shall be responsible for solving the problem at its own responsibility and cost and the Website shall not have the obligation to cooperate him/her for solution. If a complaint is made or claim for compensation for damages is filed by a third party against the Website, the Website may ask for the Website User’s cooperation to the extent necessary to solve the problem and the Website User shall give cooperation.

9. Severability

Even if a part of the provisions of these Terms and Conditions is held by the Consumer Contract Act or other laws or ordinances to be invalid or unenforceable, the remaining provisions of these Terms and Conditions and the remaining part of the provision which is partially held invalid or unenforceable shall continue to have full effect.
